What is an Occupancy Certificate (OC)?

An Occupancy Certificate (OC) is the ultimate clearance document issued by a local municipal corporation (or planning authority) confirming that a newly constructed building complies strictly with the approved building plans, civic bylaws, fire safety norms, and is legally fit for human occupation. Quite literally, moving into a flat without an OC is considered an illegal occupation and leaves buyers vulnerable to eviction or building demolition under civic laws.

It is the builder's statutory responsibility to obtain the OC. Furthermore, all major banks mandate the OC before disbursing the final tranche of a home loan.

Who can apply?

  • Builders/Developers upon full project completion.
  • Individuals constructing independent houses / bungalows upon finishing civic compliance.

Required Documents

  • Approved Building Plan and Sanction Letters.
  • Commencement Certificate and Completion Certificate (CC).
  • NOCs from Fire, Electrical, and Water supply boards.
  • Photographs of the completed structure.

Application Process

How the Builder Obtains the OC

  1. Upon finishing construction, the developer submits an application alongside the Completion Certificate (CC) to the municipal authority.
  2. Civic engineers, fire department officials, and structural engineers inspect the physical site.
  3. They verify clearances from the Pollution Control Board, Airport Authority (if applicable), and ensure no unauthorized floors or deviations were built.
  4. Once all parameters pass, the Chief Engineer issues the Occupancy Certificate.
  5. As a buyer, you must demand a copy of this OC before executing the final Sale Deed for your specific flat.
